Vuly Trampolines “Defy Gravity Challenge”

Terms and Conditions

  • These Terms and Conditions apply to persons ("you", "your", or "entrant") entering the Vuly Defy Gravity Challenge 2011 (the "Contest"). The Promoter is Vuly Pty. Ltd. (ABN 11 130 522 388) of 1/95 Ingleston Road Wakerley QLD Australia, 1300 667 514. All references to 'our', 'us', 'we' or 'company' refer to the Promoter, its affiliates and associates.
  • By entering this Contest, you will be deemed to have accepted these Terms and Conditions available at www.vulytrampolines.com/terms/videocontest, the YouTube terms and conditions available at www.youtube.com and the Terms and Conditions applicable to www.facebook.com/vulytrampolines. Failure to abide by any of these Terms and Conditions will disqualify you from taking part in the Contest and your entry will be deemed invalid.
  • Any questions, comments or complaints regarding this promotion should be directed to Vuly Pty Ltd via sales@vulytrampolines.com and not to Facebook.

Eligibility to enter the Contest

  • The Promotion is open to all legal residents of world who are six (6) years of age or older. Employees and families of the Promoter and its affiliate companies, agencies and anyone professionally connected with the Promotion are ineligible to enter the Contest or win the prize. Family members include spouses, de facto spouses, parents, natural or adopted children and siblings, whether or not they live in the same household as the employee/contractor.
  • Entrants do not need to be a member of a recognised trampoline association or institution.

How to enter the contest

  • Entry to the Contest opens at 9.00am Eastern Standard Time (“EST UTC+10”) on 7 October 2011 and close at 11:59pm EST on 30 January 2012.
  • No purchase is necessary to qualify for entry, and a purchase will not improve your chance of winning.
  • To enter the Contest, entrants are required to fill out their personal details to register for the Contest on the Vuly Trampolines Facebook platform at http://www.facebook.com/vulytrampolines.
  • Following registration, entrants will be sent a Contest Kit consisting of contest rules and contest shirt/s which must be worn during the entirety of the video entry. Entries will be disqualified if the entrants are not wearing the contest shirt in the video entry.
  • There is a maximum of 3 people permitted to participate in one entry. Only one prize will be awarded to the winning entry.
  • Videos must include a fifteen (15) second spoken introduction by the entrant indicating their name, what country they are from and a brief description of the trick/s they will perform. In addition to this, entrants must also hold up the Contest Disclaimer provided to them in the Contest Kit and recite the following: “I, [entrant’s name], willing choose to participate in the Vuly Defy Gravity Challenge and take all responsibility for any harm I may inflict on myself”.
  • Entries are submitted online via an entry form located on the Vuly Trampolines Facebook platform at http://www.facebook.com/vulytrampolines or via the Vuly Trampoline’s YouTube Channel at www.youtube.com/trampolinesaustralia. The entry must be no longer than one (1) minute and must be shot in HD video form (720p and 1080p are acceptable forms of video).
  • All video entries must be uploaded no later than 11.59pm EST on 30 January 2012.
  • Uploaded videos will appear on the Vuly Trampolines Facebook page at http://www.facebook.com/vulytrampolines and the Vuly Trampolines page on YouTube (in countries where YouTube is available) at http://www.youtube.com/trampolinesaustralia.
  • You must not endanger yourself or others, or take any unnecessary risks in order to produce or make a video to be submitted to the Contest.
  • Only one entry is permitted per person (or group of people).
  • By entering the Contest and submitting any content whether written, pictorial or in video form, the entrant hereby warrants that he/she owns all rights in such material. Entrant represents and warrants that his/her video and any other content is the sole and original creation of the entrant and has not been copied in whole or in part from any other work. The Promoter will not be responsible for the content of any material submitted by the entrant and the entrant accepts that (i) he/she will be responsible for ensuring that any material submitted does not infringe any third party rights and (ii) he/she will be liable for any claims, losses, fines, penalties, costs or damages suffered or incurred as a result of any such infringement.

Selecting the prize winner

  • The judging of eligible entries will take place at 1/95 Ingleston Road, Wakerley, QLD, Australia, 4154. A panel of two judges (one of whom is independent of the Promoter) will select the best entry to win the prize.
  • The judges will view all eligible entries and select the winning entry (“Best Overall Entry”) based on the following criteria:
    • Entrant/s have demonstrated originality in their video entry
    • Entrant/s have displayed style in their entry
    • How many Facebook and YouTube “likes” the entry received
  • The criteria are weighted as follows: 40% weight originality, 40% weight style and 20% weight number of Facebook and YouTube “likes”.
  • The winner will be notified by phone and e-mail on 7 February 2011 and will also have their names published on the Vuly Australia Website and on the Facebook and Twitter platforms at http://www.facebook.com/vulytrampolines and http://www.twitter.com/vulytrampolines.

The prize

  • The prize consists of:
    • $1000 US Dollars prize money
    • Exposure on the Vuly Australia Website, Facebook platform, Twitter platform and Vuly Blog for the winner and their trampoline club
  • The total maximum prize pool is $1000 US.
    • Only those items listed in these Terms and Conditions are included in the prize. The prize is non-transferable and will be awarded in US dollars. If part of the prize is unavailable, the Promoter, in its discretion, reserves the right to substitute part of the prize with a prize to the equal value and/or specification, subject to any written discretions from a regulatory authority.
    • The winner must claim their prize by 12.00pm on 15 February 2012 EST. In the event that a winner does not claim their prize by the above time, the winner shall forfeit his/her prize and the next best entry, as judged by the panel of experts, will be awarded the prize at 2.00pm on the above date.
    • The winner of the unclaimed prize will be notified by phone and e-mail. They will have their name published on the Vuly Australia Website, the Facebook and Twitter platforms and all other Vuly Trampolines online channels on the same date that their unclaimed prize is awarded.

General

  • For entries submitted via Facebook platform at www.facebook.com/vulytrampolines and to YouTube, to the extent permitted by law you hereby grant the Promoter, its group companies, contractors, agents and collaborators a worldwide, royalty-free, perpetual, exclusive, irrevocable, sub-licensable licence to all intellectual property rights in the entry (including all its content whether written, pictorial or in video form), which includes the right to use and reproduce the entry without restriction in any and all media, including for the purposes of the competition, for internal use, for commercial use, for publication on any websites and Facebook and YouTube pages of the Promoter and its related companies, and for use in the promotional and advertising materials of the Promoter and its related companies. If this licence is, for any reason, not effective under these Terms and Conditions, you hereby agree that you will enter into such a licence as and when requested by the Promoter on the terms requested by the Promoter (and that failure to execute any such licence will result in you being disqualified from the Contest).
  • To the extent permitted by law, the entrant hereby irrevocably waives all moral rights or other transferable rights in the material to which the entrant is or may at any time in the future be entitled or any similar provisions of law in any jurisdiction. Entrants accept that the Promoter will be entitled to reproduce video entries without attributing the dancers' name.
  • The Promoter shall be entitled to use, reproduce, modify, edit, store and retrieve all video submissions and other material in connection with the Contest or otherwise for promotional purposes in any way that the Promoter thinks fit and in any possible medium on a perpetual, irrevocable, royalty-free, worldwide basis and will not be required to obtain consent from entrants or make any payment to entrants for such use, reproduction, modification etc.
  • The Promoter and its agencies are not responsible for lost, late, damaged, corrupted, illegible, misdirected, or incomplete entries, or for entries not received due to lost, failed delayed or interrupted connections or miscommunications, or to other electronic malfunctions, delays, or errors of any kind in the transmission or receipt of entries.
  • The Promoter and its agencies are not responsible for incorrect or inaccurate entry information, whether caused by web-site visitors or by any human or technological error that may occur in the processing of entries in this Contest.
  • The Promoter reserves the right, in its sole discretion, to cancel or suspend all or a portion of the Contest, should viruses, bugs or other causes beyond control of the Promoter corrupt the administration, security or proper operation of the Contest.
  • The entrant declares that information they provide on entering the Contest is true and correct. Any entry made in breach of this declaration may be deemed invalid and disqualified at the discretion of the Promoter.
  • The Promoter reserves the right to disqualify and take down any video which, in its reasonable opinion, has been made in breach of any of the requirements of these Terms and Conditions and/or the YouTube terms of services available at www.youtube.com, the Terms and Conditions of www.vulytrampolines.com, or the Terms and Conditions applicable to www.facebook.com/vulytrampolines.
  • To the maximum extent permitted by the law, the Promoter shall not be liable for any loss and/or personal injury suffered by or to the winner that occurs as a result of the winner’s entry into the competition or consumption of the prize.
  • This promotion and these terms are governed by the law of Queensland and are subject to the exclusive jurisdiction of the courts sitting in this state.
  • An entrant’s personal data will only be held for the purpose of selecting the winner and will not be used for any other purposes whatsoever without their prior permission. Entrant’s personal information may be disclosed to State or Territory lottery departments and the winner’s name published as required under the relevant lottery legislation. A request to access, update or correct any information should be directed to the Promoter at their address set out below. Entrants grant the Promoter permission to communicate with them by phone and/or e-mail in order to provide details of the prize and/or instructions as to how the winner is to claim the prize and establish his/her entitlement to it.
